Did you even read the article? They are not the same song, they have the same title. There are hundreds of other songs with the exact title He has no valid claim. Titles cannot be copywrited.

Doug Stone or Andy Stone? (100,398) by T from USA
I read articles that it was a song from Andy Stone in 1989 but I can't find it anywhere. I do see a Doug Stone titled song called All I Want For Christmas Is You 1992 which does have a ton of the same themes as Mariah's song ends up having. Even the way he sings the last line of the chorus is similar to how Mariah ends up doing it. But Doug Stone isn't even the one suing her. Who is Andy Stone?

Unfortunately, there is a chance that she may have to pay something to this writer. There are enough similarities between the two songs. Sam Smith had to give Tom Petty a writing credit on "Stay with Me" for similarities between that song and "I Won't Back Down". Just for the record, I don't think Mariah should have to give the writer anything because thematically it's very hard to not see similarities between Christmas songs (and, really, popular songs in general). I'm just coming from the perspective of thinking how a judge will interpret the situation.

They've already said it's nothing to do with similarity's until production etc it's mearly the title he's going for. Which really won't stand for anything as there's lots of songs with same titles but completely different sounds. Headlines are there to make the whole situation sound more serious than it actually is. Next minute Mariah will be suing Enrique for using the word Hero on a song. Yeah sounds stupid doesn't it, just like this guy clearly is.

Yeah, most Christmas songs sound the same. There's nearly 200 songs with that title alone, many of which have very similar melodies. I read somewhere that this artist suing ripped off their song from "My Heart Belongs to Only You" by Bobby Vinton.

I heard Doug Stone's 1992 song All I Want For Christmas Is You. And I have to say I could see how a gifted lyricist like Mariah could take it and make it a million times more relatable. The guy released the song on Columbia Nashville records, is it so hard to believe that Tommy having access to it, stole it and gave it to Mariah after convincing her to do a Christmas song in the first place? He is the same man that a few years later did that exact same thing in regards to Loverboy. And we blame JLo with little to no proof. Tommy took the whole concept right down to the Firecracker sample. Mariah may not have even been aware of his dirty dealings back in 1994. I hope she wasn't.

I listened to the song's lyrics and actually they do have some similarities. ("All that I want can't be found underneath the Christmas tree", "Santa can't bring me what I need cause all I want for Christmas is you"). Both songs are basically telling the same story so Mariah may have to defend herself on this. The news of this has already made headlines even here in France where it's pretty unusual to see something Mariah related in the news nowadays.

Yes, completely agree. MTV Unplugged is both my favourite album and DVD of Mariah's, and I think I was drawn to it for all the reasons MC mentioned on her post. It was spontaneous, no one had any grand allusions as to what it would become, she sounded amazing and genuinely in her element, I'll Be There was the crest of the wave that was growing throughout the evening, and she seemed so humble and thankful and grateful. It's one of her career highlights to my mind.

I think Mariah would never sell her music. I believe I read somewhere (either in her memoirs or in interviews) that she said about some company wanted to buy Alone In Love in the 80's to be featured in a movie soundtrack but she refused and said no. The best is to let Mariah's children to to inherit the catalogue and later passed on to their next generation. They don't have to work anymore, just milk the catalogue for movie soundtracks, jingles, remixes etc.

She's been in control of her image since Butterfly. Exactly. I think Mariah is in a talent league of her own. Master-class proved that one, as if I needed more proof. But MC has always been insecure. I think the "diva, dahling" act is just that: a cover. I'd love to see how she is behind closed doors. I doubt it's anything like what we see in pubic.

I absolutely agree with this entire post. It feels like it is in line with the one I just made as well. Mariah's case is unique in that the mainstream machine that held the standard of expectations to "entertain" the audience was inseparable from her husband. Her rebellion against him, was her rebellion against the mainstream music beast Sony. The Mary J story reminds me of the dilemma of a marriage based in true love vs one of financial convenience.

This is a pretty insightful take. I also thinks it's pretty accurate. The fact that she, like Prince, also continued to pursue her artistic interests despite the loss of commercial success also lends credence to the idea that she isn't overly pressed about maintaining the love of the general public. Caution is her most critically acclaimed album and possibly her lowest selling. Questlove said it best when he said that he loves that Mariah stays true to herself and her artistic vision without trying to just copy what is current.

But not copying the current trap sound comes at a cost. The cost is not being as beloved among the general public. It's a price she seems willing to pay. She has dem babies. She has the lambily. And she has the respect of her peers. That's apparently enough, and I say good for her. Madonna took the route of trying to maintain the love and respect of the general public and I'll just say I'm glad Mariah doesn't feel the need to go that route.

I also like how you pointed out that every diva had their diva antics. If nothing else, I feel Mariah has earned hers.
